OFFICIAL RULES:
CUSTARD PRESENTS A TRIP TO NEW YORK CITY, H&M SHOPPING SPREE AND VIP PASSES TO SEE BEN JELEN CONTEST
NO PURCHASE NECESSARY 1) How to Participate: This contest starts July 2, 2007.
There are two ways to enter into the contest: (a) on the Internet, at www.cog1.com/custard/benjelen/email.html, or (b) at www.benjelen.com (click on ‘interact,’ then ‘contests’).
2) Eligibility. This contest is open to legal residents of the 48 contiguous United States, other than Florida, who are 18 years of age or older. Employees, directors and their immediate families or members of household of: Custard and other prize sponsors and participants, their respective parent companies, subsidiaries, advertising, production, promotion and publicity agencies, and anyone connected with the production and distribution of this Contest are not eligible to enter or be awarded a prize.
3) Prizes, Approximate Retail Value and Odds (as of July 3, 2007): One Grand Prize: Two VIP passes to a Ben Jelen live performance (exact date TBD), one H&M gift certificate, roundtrip airfare from nearest major airport in the continental 48 states to New York City, NY for two people, and two nights stay (room and tax only). Prize features include tickets to the show, airfare and hotel accommodations, one H&M gift certificate, and two Ben Jelen merchandise prize packages. The approximate retail value of the Grand Prize is $1,500. You must be prepared to take the trip on a weekend (Friday through Sunday) in the year 2007. All travel details will be at Sponsor’s discretion. Prize may be forfeited if winner is unable to travel during the designated time period. Odds of winning the prize depends on the number of eligible entries received. One entry per person. Sponsor may disqualify any entrant violating these rules.
4) Winner Selection. Custard will conduct contest administration and verification. The Winners shall be selected at random from all valid entries received by Custard by December 30, 2007. By participating in this Contest, you agree to abide by and be bound by these Official Rules and the decisions of Custard whose decisions are final. The sponsor reserves the right to disqualify any entrant from the Contest if, in Sponsor’s sole judgment, entrant has not complied with these Official Rules. Grand Prize winner will be notified by telephone by December 30, 2007 and will be required to execute and return, via fax, an Affidavit of Eligibility, Publicity and Liability Release (the traveling companion will also be required to execute and return a Publicity and Liability Release) within 72 hours of notification or prize will be forfeited and an alternate winner may be selected. Sponsor not responsible for illegible, lost, late, misdirected, postage due, damaged or incomplete mail. Prizes do not include anything not specifically mentioned as part of the prize in these Official Rules. It is the sponsor's intention to award only the prize described in the Official Rules. Entrants agree to release and hold harmless Custard sponsors and participants, their respective licensees, franchisees, affiliates, parent companies, subsidiaries, successors and their respective directors, officers, employees, advertising and production agencies from all liability regarding participation in the Contest, the receipt and use of prize awarded and, without limiting the generality of the above, from any injury or death while using the prize. Prize winner waives the right to 1) to assert as a cost of winning a prize any and all costs of verification and redemption or travel to redeem that prize and 2) any liability claim which might arise from redeeming or seeking to redeem that prize. Prizes are non-transferable and no substitutions or exchanges or cash equivalents will be allowed except by sponsor. Sponsor reserves the right to substitute prizes of equal or greater value and approximately similar features for any prize mentioned in these rules due to unavailability. Contest void in whole or in part where prohibited, licensed, restricted or taxed. All taxes are winner's responsibility (other than room tax described above). All federal, state and local regulations apply. All materials submitted become the property of the sponsor and will not be returned. Sponsor reserves the right to use winner's name and likeness, including photographs taken by the sponsor’s photographer, for publicity use, without any further consent or compensation, unless prohibited by law.
